ABSTRACT

This paper seeks to discuss the moral and sexual harassment
that happens in the national and foreign artistic milieu, the influence
of cultural and social aspects that permeate this work environment,
the legislative differences regarding the typification of crime and
punishment of harassers and the change in the positioning of
employers in the face of cases of moral and sexual harassment that
arise in the artistic sphere. Based on hermeneutic definitions and
analysis of factual cases, some peculiarities of the entertainment
industry will be demonstrated, such as the downward verticalization
between harasser and harassed, the delay in exposing cases due to
the culture of harassment and the culture of fear, mass denunciations
for the “herd effect” and public exposure of the punishment given to
harassers.

INTRODUÇÃO

Em outubro de 2017, uma onda de denúncias de assédio e
abuso sexual inundou os tabloides dos Estados Unidos. As acusações
começaram quando o prestigiado jornal The New York Times denunciou

o produtor Harvey Weinstein por décadas de assédio sexual contra
várias atrizes e funcionárias, que passaram pelas produtoras Miramax e
The Weinstein Company.
Naquela época, Weinstein era um dos mais poderosos executivos
de Hollywood. Os relatos indicavam um histórico de abusos e até mesmo
estupros ocorridos no decorrer das últimas três décadas, que tinham
como alvo mulheres jovens e bonitas, que aspiravam a uma carreira na
concorrida indústria cinematográfica.
Algumas das vítimas são famosas atrizes de Hollywood, tais
como Gwyneth Paltrow, Lea Seydoux, Angelina Jolie, Mira Sorvino, Cara
