sobre o assédio, em relação ao adotado na esfera penal. Conclui-se que,
embora já presente em alguns julgados, a percepção das questões de
gênero merece maior consideração pela Justiça do Trabalho.

ABSTRACT
The article analyzes sexual harassment at work from the perspective
of the gender issues, considering that the victims of harassment are almost
entirely women, and harassers are usually men. The research identifies
black women as the most frequent targets of harassment, indicating
an interseccionality of gender, race and class factors. This perspective
has the purpose of investigating the reasons for underreporting, the
victims’ silence, as well as enabling a more comprehensive access to the
context of the agent and the victim, questioning notions of consent and
seeking to obtain a more complete understanding of the phenomenon.
In the end, the work presents an analysis of some sexual harassment
judgments by the national labor courts, investigating the existence or not
of the magistrates’ perception regarding the thesis that harassment is
configured as gender violence. The methodology used was bibliographic
and jurisprudential analysis, and also the use of secondary data to
situate the field of discussion. The results point to the need to expand
the labor understanding of harassment, in relation to that adopted in
the criminal sphere, and it is concluded that, although already present
in some judgments, the perception of gender issues deserves greater
consideration by the labor courts.

I INTRODUÇÃO
O silêncio é o que permite que as pessoas sofram sem
remédio, o que permite que as mentiras e hipocrisias
cresçam e floresçam, que os crimes passem impunes.
