ABSTRACT

The aim of this study is to reflect how and under what circumstances
bullying at work affects the dignity of the working person. With this goal,
a bibliographic research was carried out considering the contribution of
authors such as GARCIA (2017), in order to define moral harassment, also
known as mobbing, classifying its species and the consequences they cause
to the harassed. Furthermore, it was verified how the subject is dealt with in
the Brazilian legal system, both in legislation and in the courts, concluding
that the country’s federal legislation is incipient when dealing with the
matter, with only bills passing through the National Congress to protect
it exclusively. Thus, the reality today is that it was up to the constitutional
principles, especially the dignity of the human person, to subsidize and
substantiate the requests and decisions of conflicts between harassers and
harassed, seeking the best interest of the last.

INTRODUÇÃO

As relações de trabalho estiveram presentes na sociedade
humana desde os seus primórdios, como forma de as pessoas buscarem
a vida em comunidade, bem como a própria sobrevivência. Com o
desenvolvimento da civilização ao longo dos séculos - notadamente
após a criação da propriedade privada -, foram desenvolvidas relações
de hierarquia e poder, nas quais o homem passou a ser explorado pelos
seus pares. Aqueles que detinham o poder também eram donos do que
era produzido pelo subordinado.
A subordinação do trabalhador em face do patrão permaneceu no
decorrer das décadas e cresceu principalmente no período da revolução
industrial e fortalecimento do capitalismo. Tal relacionamento deu azo
a práticas despóticas por parte dos detentores dos meios de produção -
principalmente a ações que imprimiam tratamento hostil e humilhante,
