Trab. 3ª Reg., Belo Horizonte, v. 70, n. 110, p. 117-137, jul./dez. 2024118Abstract: We are living in an era of absolutization of references inherent to the mere technical and instrumental operationality of reality, which has also been seen within the Judiciary, in which announcements by Courts and the Justice Councils themselves are proliferating, regarding the launch of large-scale language models (LLMs) for judges and civil servants, even before the enactment of CNJ Resolution 615/2025, which regulates the development and use of such tools. This is a worrying trend, in which procedural actors, thoughtlessly, delegate to technology aspects related to what should represent an expression of conscience. Forming tradition and forming oneself in tradition is equivalent to the continuous process of affirming the human meaning of existence, in this “crossing” that appears as the guiding thread of history, incapable of finding an equivalent in the simple mechanical passage of data from the input to the output of generative artificial intelligence models.Keywords: large-scale language models (LLMs); hermeneutics; natural language processing (NLP).INTRODUÇÃOA utilização de ferramentas desenvolvidas com recursos de Inteligência Artificial no Poder Judiciário encontra-se regulamentada pela Resolução CNJ n. 615, de 11 de março de 2025, que em seu art. 19 dispõe que os modelos de linguagem de larga escala (LLMs) e demais sistemas de inteligência artificial generativa (IAGen)[...] poderão ser utilizados pelos magistrados e pelos servidores do Poder Judiciário em suas respectivas atividades como ferramentas de auxílio à gestão ou de apoio à decisão, em obediência aos padrões de segurança da informação e às normas desta Resolução.A norma traz diversas diretrizes éticas voltadas ao uso “[...] adequado e responsável de LLMs e sistemas de IA generativa pelos magistrados e servidores”, inclusive determinando a realização de capacitação e treinamento continuados de magistrados e servidores, para se garantir um uso adequado de tais sistemas (vide art. 19, § 5º, da referida norma).
