A partir da jurisprudência recente do Tribunal Regional do Trabalho da 3ª Região (TRT-3) e de experiências internacionais, em especial o modelo chinês de vigilância em massa, o estudo evidencia como a subordinação algorítmica já transforma as relações de trabalho e ameaça direitos fundamentais. Propõem-se, ao final, diretrizes para que a adoção da IA no Judiciário respeite a dignidade humana, a transparência, o devido processo legal e a proteção de dados, evitando a desumanização da prestação jurisdicional.Palavras-chave: Inteligência Artificial; subordinação algorítmica; Judiciário; transparência; direitos fundamentais.Abstract: This article analyzes the ethical and legal risks associated with the implementation of Artificial Intelligence (AI) in the Brazilian Judiciary. Based on recent case law from the Regional Labor Court of the 3rd Region (TRT-3) and inte rnational experiences, particularly the Chinese model of mass surveillance, the study highlights how algorithmic subordination is already reshaping labor relations and threatening fundamental rights. The article proposes guidelines to ensure that the adoption of AI respects human dignity, transparency, due process, and data protection, preventing the judiciary from becoming a mechanical and unaccountable system.* Advogado militante em Minas Gerais.
